PRESSIDCARD.COM provides a cloud-based Software-as-a-Service (SaaS) platform that enables:

• Creation and management of digital Press Identity credentials
• QR-code based verification systems for authenticity checking
• Automated generation of official media documents (6+ document types)
• Member management and approval workflows
• White-label portals for news organizations

3. Account Registration & Eligibility

3.1 Eligibility Criteria

To register as a Channel Admin, you must:

• Be at least 18 years of age and legally competent to enter contracts
• Operate a legitimate news organization (RNI registered, Web Portal, or YouTube Channel with substantial content)
• Provide accurate RNI Registration Number (for print media) or Channel URL (for digital)
• Have authority to issue Press IDs on behalf of your organization
• Not be barred from using IT services under any Indian law

We reserve the right to:

• Request proof of RNI registration or channel ownership
• Verify your organization through independent checks
• Suspend accounts pending verification
• Reject applications from suspicious or non-media entities

4. Acceptable Use Policy (AUP)

The following activities are strictly prohibited:

• Fake Credentials: Creating press IDs for non-journalists, fake news sites, or individuals not associated with legitimate media
• Impersonation: Using logos, names, or branding of other news organizations without authorization
• Fraudulent Activity: Using stolen payment methods, fake RNI numbers, or false organizational details
• Harmful Content: Uploading malware, hate speech, or illegal content through member profiles
• System Abuse: Scraping data, DDoS attacks, attempting to breach security, or reverse engineering
• Reselling: Purchasing credits and reselling ID card services to third parties without authorization
• Misrepresentation: Claiming government affiliation or official RNI status for the platform

5. Content & Intellectual Property

5.1 Your Content

You retain ownership of:

• Your organization logo and branding
• Member photographs and information
• Stamp images and signatures uploaded

You grant PRESSIDCARD.COM a non-exclusive, royalty-free license to use this content solely for:

• Generating ID cards and documents
• Displaying on QR verification pages (public profiles)
• Platform operation and technical support

5.2 Our Intellectual Property

PRESSIDCARD.COM retains all rights to:

• Software code, algorithms, and platform design
• Card templates and document layouts (excluding your branding)
• QR code generation system and verification technology
• Trademarks, logos, and brand assets of PRESSIDCARD.COM

You may not copy, modify, distribute, or create derivative works from our platform without written consent.

5.3 Accuracy of Information

You are solely responsible for:

• Verifying the identity and credentials of members before approval
• Ensuring spelling accuracy in names and designations
• Confirming uploaded photos belong to the actual member
• Maintaining updated RNI registration status

6. Payment Terms

6.1 Pricing & Credits

• First 2 ID cards are provided free as a trial (one-time per organization)
• Subsequent cards require purchase of prepaid credits
• Pricing is subject to change with 7 days prior notice
• Credits are valid for 1 year from purchase date

6.2 Refund Policy

Refunds are governed by our Refund Policy. Key points:

• Used/consumed credits are non-refundable
• Unused credits refundable within 2 days of purchase only
• Technical failures on our end eligible for full refund

6.3 Taxes

All prices are inclusive of applicable GST (18%). Invoices will be provided for all purchases.

7. Termination & Suspension

7.1 By You

You may close your account at any time. Note that:

• Remaining credits will be forfeited (if outside 2-day refund window)
• Generated ID cards remain valid until natural expiry
• Public QR profiles remain accessible until expiry

7.2 By Us

We may suspend or terminate your account immediately for:

• Violation of Acceptable Use Policy
• Fraudulent registration or payment
• Issuing IDs to criminals or anti-social elements
• Non-use for 12 consecutive months (dormant accounts)
• Legal requirements or court orders

7.3 Effect of Termination

Upon termination:

• All licenses granted to you cease immediately
• You must cease using all generated materials (IDs become invalid)
• We may delete your data after 30 days (per Privacy Policy)
• No refund of unused credits if terminated for violation

8. Limitation of Liability

8.1 Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

• Uninterrupted or error-free service
• Specific press privileges or access rights
• Acceptance of IDs by third parties (police, event organizers)
• Accuracy of member-provided information

8.2 Limitation of Damages

To the maximum extent permitted by law, PRESSIDCARD.COM shall not be liable for:

• Misuse of ID cards by your members
• Legal consequences of false information provided by users
• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Any damages exceeding the amount paid by you in the last 6 months

8.3 Indemnification

You agree to indemnify and hold harmless PRESSIDCARD.COM and its officers from any claims arising from:

• Your use of the platform
• Content you upload
• Activities of your approved members
• Violation of these Terms

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically:

• Information Technology Act, 2000
• Indian Contract Act, 1872
• Copyright Act, 1957

9.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts in [Your City, e.g., Delhi, Mumbai, Bangalore], India.

9.3 Dispute Process

1. Negotiation: Attempt to resolve amicably within 30 days of written notice
2. Mediation: If unresolved, attempt mediation under Indian Mediation Rules
3. Arbitration: Finally, binding arbitration under Arbitration and Conciliation Act, 1996

10. General Provisions

10.1 Changes to Terms

We may modify these terms at any time. Changes will be effective 7 days after posting. Continued use constitutes acceptance.

10.2 Severability

If any provision is found invalid, the remaining provisions shall continue in full force.

10.3 Assignment

You may not transfer your account without our consent. We may assign our rights without restriction.

10.4 Entire Agreement

These Terms, along with the Privacy Policy and Refund Policy, constitute the entire agreement between you and PRESSIDCARD.COM.
